What data will we process, and for what purposes?
Applications. Initially, we will process the data you send us with your application to make a decision on our potential working relationship and to contact you about this.
Representation. If we agree to work with each other, we will process data transmitted to us by you to represent you as a talent, actor or influencer, to suggest you for suitable castings and enquiries and to provide all relevant data to the clients for their production if they go ahead and book you. Apart from your photos and videos, this includes
- Contact data, such as your address, e-mail or mobile number
- Basic information, such as your date of birth, gender, nationality or where you are based
- Physical characteristics, such as clothes size, height, eye colour, hair colour or shoe size
- Other relevant details, such as tattoos, special skills, languages, education, acting experience, projects or shoots you have been on or what driving license you have
- Personal data protected by Article 9 GDPR. You may voluntarily provide information about your ethnic origin. This is often helpful for castings because clients tend to ask about this and it may not be obvious in your pictures. If, for certain projects, clients ask about your sexual orientation or marital status, we will process any information you voluntarily provide to us about this.
Invoicing. We will process payment and billing information to invoice clients and to pay your fees and buyouts to you.
Documentation. We may store information about enquiries, negotiations about fees or buyouts and bookings to document our work and for potential future warrancy claims or legal disputes.
Accounting. We will process data required for invoicing and tax purposes for our accounting and to comply with statutory retention periods.
Business partners. We will process contact and communication data of our business partners and their employees to the extent necessary for processing enquiries and handling bookings.
What is the legal basis?
We mainly process personal data for the representation of our talents and to offer them suitable jobs. The legal basis in these cases is usually Article 6 (1) b GDPR.
Data which are specially protected according to Article 9 GDPR will only be processed with your consent. The legal basis in these cases is Article 9 (2) a GDPR. You may revoke your consent to future processing at any time. Just talk to us or write to info@dbps.de.
The legal basis for data processed to comply with statutory retention periods is Article 6 (1) c GDPR.
Where the processing of your data is based on our legitimate interests described above, the legal basis is Article 6 (1) f GDPR.
Am I obligated to provide my data?
You are obliged to provide personal data only insofar as we are required by law to collect and process these data, such as your tax number. All other personal data are provided voluntarily. But without the required data, we will usually not be able to represent you.
How long will we store your data?
Applications. We will delete your data without delay if we decide against working together. Data of talents we decide to represent will be stored in our database.
Representation. We will store your data for as long as we represent you. If our working relationship end, we will delete your data, unless we are legally required to keep to comply with statutory retention periods.
Invoicing and accounting. We will store your data for the relevant statutory retention periods (10 years for all data relevant for tax purposes, 6 years for other business communications).
Documentation. Data stored for documentation purposes can be stored for as long as this documentation is required or any warrancy or legal claims exist.
Business partners. Data of our business partners and contact persons will be stored for the duration of the business relationship.
Who else will receive your data?
We will publish photos, videos and other data such as your first name, height, eye and hair colour, clothes and shoe size, year of birth on our website.
To suggest you for projects, we will share your data with potential clients in Germany and abroad. This includes film and photo production companies, casting agencies, photographers, ad agencies or advertisers. Data may also be passed on to the client’s subcontractors, clients, hotels or travel providers, to the extent that this is required for the booking or enquiry.
Finally, your data will be passed on to payment providers, tax advisors or tax authorities, to the extent this is required for accounting and invoicing purposes.
Will data be processed outside the EU?
We will process all your data on our premises and in data centres in Germany.
However, if clients (or their clients or service providers) are based outside the EU or the EEA (European Economic Area), your data will also be transferred there. Insofar as these countries have not been recognised by the EU Commission as a safe third country in terms of data protection, they may not have an adequate level of data protection. The transfer of your personal data in these cases is based on Article 49 (1) c GDPR, as it happens in your interest in a booking with the client.
